Nanuet Man Allegedly Caught Beating Disabled Patient on Video

There’s no use crying—or assaulting someone—over milk, according to Attorney Gen. Eric T. Schneiderman.

Earlier this week, Schneiderman announced charges against a Nanuet man who claims a 55-year-old disabled patient attacked him after he took away the patient’s carton of milk.

However, the attorney general says videotapes show Lennox Seymour, a 46-year-old former licensed practical nurse, is the one who was doing the assaulting.

“The defendant, a licensed caregiver, was entrusted with the protection and well-being of a disabled nursing home resident,” said Schneiderman, in a press release. “He violated that trust by attacking his own patient. My office will punish those who commit crimes against our most vulnerable neighbors.”

A Feb 12, 2012 video from the Split Rock Rehabilitation and Health Care Center’s cameras allegedly show Seymour follow the disabled man into the Bronx facility’s dining area around 11 p.m., pushing the patient against the wall and punching him in the neck.

The video reportedly shows the two men struggling and falling to the floor, before Seymour walks away leaving the victim with injuries to his neck and buttocks.

According to the attorney general’s office, the tapes contradict Seymour’s account of getting punched and kicked by the 55-year-old after he took away a carton of milk.

The felony charges against Seymour are as follows:

  • Endangering the welfare of a vulnerable elderly person and an incompetent and physically disabled person in the second degree
  • Falsifying business records in the first degree

He is also charged with the following misdemeanors:

  • Falsifying business records in the second degree
  • Endangering the welfare of an incompetent and physically disable person
  • Willful violation of health laws

Seymour could face up to four years in prison if convicted.
