New Jersey Man Charged Under Leandra's Law

Jose Antonio Pichazaca Guaman, age 27, of Irvington, NJ, pled guilty on February 24 to Aggravated Driving While Intoxicated with a Child. 

District Attorney, Thomas P. Zugibe said he had been driving in Spring Valley at 5:44 a.m.  Nov. 3, 2013, while intoxicated, with a child in the vehicle. 

According to the Child Passenger Protection Act:

  • First-time offenders driving while intoxicated (.08 blood alcohol content or more) or impaired by drugs while a child younger than 16 years old is in the vehicle may be charged with a Class E felony punishable by up to four years in state prison.
Sentencing is scheduled for May 5, 2014 before the Honorable Charles Apotheker, County Court Judge.
