Union Sues Rockland County For Free Prescriptions (VIDEO)

With the elimination of the county's in-house pharmacy, county employees—both current and retired—as well as their families will not be able to fill prescriptions with no added co-pay any longer

 

Despite the cold and windy conditions, CSEA representatives gathered in front of the Rockland County Courthouse on Friday afternoon to hold a press conference announcing the lawsuit they just filed against County Executive Scott Vanderhoef.

Vanderhoef eliminated the county’s in-house pharmacy, a longstanding benefit.

Attorneys for the union filed an Article 78 action in Rockland County Supreme Court on Friday charging Vanderhoef violated county law with his closure of the county pharmacy.

“We’re looking for reinstatement of the pharmacy and reinstatement of the medication at no cost,” said Paul Bamberger, CSEA senior counsel. “There is a law, which is passed by the county legislature, that says the county executive has to provide these benefits … the county executive is not following the law.”

The lawsuit was filed for both the current workers and retirees, Bamberger added.

“We spoke with (Vanderhoef) after he announced the pharmacy closure to remind him of the existing county laws providing for the pharmacy benefit and to give him a chance to put a stop to his plan,” said CSEA Southern Region President Billy Riccaldo. “His Refusal to obey these particular laws has forced us to pursue legal action to ensure CSEA’s active members and retirees regain access to a benefit guaranteed to them under law.”

County Attorney Jeffrey J. Fortunato issued the following statement on Friday in regards to this.

“We have not yet been served with any papers signed by a Judge so we cannot comment on CSEA's actions. However, we have stated from the beginning that any past practice with respect to the employee pharmacy is not enforceable against the County due to:"

  1. Clear and unequivocal language set forth in the collective bargaining agreement with respect to the prescription drug plan
  2. Management's rights language contained within thecollective bargaining agreement affording broad discretion to make managerial decisions suchas program terminations
  3. The potential gifting of public funds. 

"Accordingly the County may take unilateral action without prior negotiation with the union," said Fortunato.

This was a benefit that was given to the employees by the legislature in 1983 for insurance purposes, said Riccaldo. He added that this benefit helps employees pay for other things, such as tuition, daycare and little league for their kids.

“This is also a violation of the trust the employees have in their government because they’ve promised something for years and now they’re taking it out,” said PT Thomas, CSEA Rockland Co-Unit President. He added that he’s gotten numerous calls from union members saying that they’re now having to choose between feeding their families or buying prescription drugs for their families. “And in the 1980s, they had to give up their salary increase to get this benefit.”

“As a county retiree on a fixed income, the pharmacy closure will have a tremendous impact on me and so many of my former county co-workers,” said Larry Rees, a lifelong Rocklander and 32-year county employee who relies on the county pharmacy for numerous prescriptions each month. “Once I received the notice of the pharmacy closure, I called another local pharmacy and found out that the co-pay for one particular medication alone will be $90. There are going to be people who are just unable to fill their prescriptions because they cannot afford the co-pays. Retirees had no way of planning for this expense because we were assured the pharmacy was a benefit guaranteed to us.”

The CSEA said that on Jan. 4, 2013, Vanderhoef issued a memo announcing his plan to close the county pharmacy and end the practice of employees and retirees being able to fill prescriptions there with no added co-pay; this violated several laws passed by legislators:

  • Resolution No. 647 of 1985, which authorized the county pharmacy to fill prescriptions of employees using the county health insurance plan if the employee chose that pharmacy, and which waived the co-payment
  • Resolution No. 630 of 1989, which exteneded the pharmacy benefit to all county employees
  • Resolution No. 545 of 2003, which affirms the legislature’s opposition to “any unilateral curtailment reduction or undermining of any such benefits to the detriment of our past or present employees without negotiated agreement with and by those employees.”
  • In addition, the CSEA said that legislators amended Rockland County Code in 2005 to state that county retirees with the required years of service to be eligible for retirement benefits should receive the “same level of health benefits consistent with past practice they received on the last day of their employment, which shall be continued upon retirement.”

“The pharmacy closure impacts a lot of people, but it has been most harmful to the residents of this county who retired from county service, live on a fixed income, and had no way to budget for this unexpected prescription drug cost that Mr. Vanderhoef blindsided them with,” said Riccaldo. “This really shows a lack of respect for so many people who gave so much of themselves to this county.”

Welcome to the real world CSEA employees..A world where most of us pay co-pays and still don't have as good a health plan as civil service employees.. What are you and your union leaders going to complain about next ? No shopping on the Internet or going to doctor appointments during working hour??.Or maybe actually working a full work day instead of putting your jackets on and checking out 15 minutes early..Give us taxpayers a break already and stop moaning already and just be happy you have the easy jobs you fell into..

1. We have co-pays with our insurance plans also.
2. We have a smaller paycheck in exchange for said benefits. 3. Not that it is your business but I don't use my work hours for my doctors appointments. 4. If I did leave early it is only because I came in early or ended up working through part of my lunch time to make sure some one's computer is up and running so they can continue to work. 5. I did not fall in to my job I applied for and was fortune enough to be the one hired for the job I do. 6. I pay taxes just like anyone else and if I don't like something I have the right to say some thing about it just like you do. 7. We gave back 10 works days without pay and no pay increase for the next 2 years. What did you give back to your company just to keep "THE EASY JOB YOU FELL INTO"?????????

No one receive FREE LIFETIME HEALTHCARE FOR LIFE after just 5 YEARS that works or has worked for the county. I don't know where you found this statement that you think is correct but I would suggest you research what you think might be fact before you write it.

I am sorry, but I also have to work to make ends meat, and poor old me has to pay insuranse and has to have a co pay - We all know times are tough, but suck it up and stop crying when you do not get your own way

"Due to an insane benefit program, employees are entitled to lifetime Healthcare benefits after 5 years of service, which was never funded. At this time that item alone accounts for $32 million a year or 30% of the current tax levy and is projected to exceed $50 million by 2019. When combined with the current Pension Plan contribution it practically consumes the entire tax levy"

AB actually according to the Counties GASB 45 report the actual requirement is 5 years with the county or 3 years with the County and 2 years with any other state government and age 55,aT AGE 50 YOU CAN PAY FOR YOUR BENEFITS UNTIL YOU ARE 55and then they are free.You are the one who should check your facts.

I work for my money too and I am tired of working so that I can pay for others to get free stuff. These union workers have jobs, they can pay for their own prescriptions. Maybe it means their bottom lines will be less, deal with it or find another job but don't ask me to pay your bills, I have my own to pay.

I am pro-union but you must be realistic in this economy. It was nice while it lasted time to move on to reality. If we all give a little (both directions) and stop whining, complaining and being so righteous maybe things won't be so difficult. We are being taxed right out of our house. Its so sad where do you go? I don't want to leave my home but if the taxes, food, gas, utilities keep rising at this rate we may have to. :-( I know I am no along in this situation. Salaries are being cut or frozen but all expenses are going up and up.

You were darn lucky to have no copays for as long as you did. Most people who are even lucky enough to have drug coverage has large co-pays. My granddaughter has a medication that the co-pay is $500.00 a month and yours would have been free. Time to pay your dues to copays and maybe less to union dues. Local, State and Federal Gov't's are broke and need to cut excess costs. Time to join the real world with the rest of us.

IN MY PRIOR JOB I HAD QUITE A FEW OCCASIONS TO VISIT THE COURT HOUSE AND WAS AMAZED AT HOW MANY WORKERS STOPPED TO CHIT CHAT PERSONALLY WITH OTHER WORKERS. I WAS WITHIN HEARING DISTANCE AND KNEW THAT IT WAS PERSONAL. MOST TIMES ABOUT 10 TO 15 MINUTES. I WOULD HAVE LOVED TO REPORT THEM BUT I FELT IT WOULD HAVE BEEN TO DEAF EARS. WE WERE PAYING FOR THIS WASTE OF OUR TIME. NOW THEY CAN PAY IT BACK BY PAYING CO-PAYS. IF EVERYONE COMPLAINED OF SEEING COUNTY EMPLOYEES DOING NOTHING WHEN THEY WERE SUPPOSED TO BE WORKING I THINK THAT THERE WOULD BE TOO MANY TO POST ON THIS WEBSITE.

there needs to be a revolution if this gets reinstated. It will deserve it's own website + forum and it should get as much attention as possible from everyone in the country not county. rockland county needs to get real. everyone who lives here or might plan to needs to know what they are getting into.

smaller than what and this free prescription program was added long after plenty of people were hired. so they agreed to work for x money then got y money due to no copay

The county workers are just following their leaders. The county sued the Town of Clarkstown over a closed town road, so now their workers are suing them. The sense of privilege is endless.
Aw, you're going to have to pay a copay now? Oh, well, I'm sure that the county workers are just like any others - good ones and poor ones. However, from paying practically nothing for insurance and $5 copays for prescriptions, my family is now up to almost $600 per month and $45 copays, IF the insurance company considers it one of their "preferred" drugs. Reality sucks, ladies and gentleman. Welcome to it.

In fact, bankruptcy is what the county and towns should do so they can legally throw these rediculous contracts out the window and start over. Wake up people! Your current politicians are kissing union butt for votes and don't care about the rest of us hard working tax payers who can no longer afford to live here.

Martin I know my facts since I am a county employee and according to what I think your read on page 68 of said report. You assumed that all get that same 5 yr deal which not the case "The various collective bargaining agreements stipulate the
employees covered and the percentage of contribution. Contributions by the primary government and its College component unit may vary according to length of service." I personally must be there 20yrs and be min age 50 but must pay a cobra for 5yrs in order to retain my health benefits according to HR.

No other state, county or local government emplyee in NYS enjoys the Free Pharmacy as the Rockland Cty emplyees do. In this day and age with layoffs, people struggling to get by, it is indeed a disgrace and downright greed. Not one concession; just take and take and take. No layoffs, no cutbacks; just hike taxes some more. The fools out there will simply pay until the county goes bankrupt! Thank you caring CSEA!

I belong to a union myself, and our union medical insurance defrays a percentage of our pharmaceutical costs, but our pharmaceuticals are not, not have they ever been, FREE. I don't know of anybody who has medical insurance like that, with the possible exception of politicians.

The question is was this a negotiated benefit and is it in writing? If so then the CSEA is correct to contest this in the courts. That is the legal recourse provided. Especially if said benefit was in lieu of past salary increases. If certain people object then agree to disagree. Union leadership is never for the weak. Jeff Meyer Tuckahoe, NY

if yes did it include vitamins.yes or no did they ever get free medical and prescriptions for their pets..yes or no did they ever get any benefits, free or other for their pets..if yes which ones are included if this gets reinstated will it apply to pets..yes or no if pets are covered what pets are included and what benefits do they get

Liberals can never forsee the consequences of their actions. They have spent 4 years demonizing and taking money from the prosperous. Maybe the prosperous her done paying for these freebies.

Hopefully the current public CSEA contract will be able to be read by residents of Rockland. I believe if it is readily available. It will show how well, and what our County Management negotiated. It may also reflect on the competence of our elected officials.
